Managing reward
The 50% income tax rate in the UK, which we expect to be a short term measure, means that it is ever more important to consider the timing and form of remuneration and dividends from business interests and to consider how savings can be invested for tax efficient returns. Business structures such as limited partnerships are now popular as an alternative to limited companies in circumstances where a family wishes to spread earnings potential among a wider group and perhaps take advantage of allowances and capacity to absorb income at lower rates of tax.

Prior planning for substantial dividends or exits might include considering leaving the UK, an area in which we have much experience of the practice of HM Revenue & Customs. Key to success in this area is in the level of detail in planning an exit; HMRC will examine all such departures in minute detail before accepting tax is not due here.
Planning offshore investment
Because of tough anti-avoidance rules, any private investment overseas will require careful structuring to ensure that income and gains of a non-resident company or trust, for example, are not attributed directly to a UK investor with tax becoming payable regardless of whether any of the proceeds are paid to that person.
